TERMS

The Seller guarantees the Puppy to be free from infectious diseases for 3 days after leaving our premises. The Puppy will leave our facility clean, in good general health, and with no physical defects. 

Ø  Buyer(s) must take their puppy to their veterinarian within 48 hours of receiving the Puppy. Failure to have the puppy examined by vet within 48 hours, or if the Buyer fails to provide required immunizations or de-worming, this health guarantee will be void.

Ø  If the chosen veterinarian of the Buyer(s) finds the Puppy to be in poor health, the veterinarian’s written description of the problems must be provided, dated within 3 days of the date Buyer received the Puppy.

Ø  With documentation from the veterinarian that indicates a specific genetic defect (must indicate which defect or disease, and signs or symptoms that led to the diagnosis), the Buyer will return the Puppy within 48 hours of delivery or diagnosis, whichever comes later, in the original shipping crate at the expense of the Seller, and will be offered a replacement puppy, as soon as one is available, shipped in the original crate at Seller’s expense. A replacement puppy will not be provided until the Seller’s veterinarian validates the diagnosis of the Buyer’s veterinarian.

ADDITIONAL CONDITIONS

Ø  Buyer must keep the growing Puppy at a healthy weight appropriate for its size; must prevent harmful exercise that strains or negatively impacts joints or teeth; must feed their puppy a nutritious and quality brand of dog food that is specifically formulated for large-breed puppies.

Ø  The Seller shall not be responsible for any medical costs incidental to the Puppy after Buyer(s) receives the Puppy, other than those terms described in the terms of the guarantee.

Ø  There are certain disorders that may be caused by environmental factors and stress, such as immunity level, mites, pneumonia, mange, heatstroke, ringworm, conjunctivitis, fleas, ticks, ear infections, allergies, thyroid dysfunction—these are not covered by this guarantee.

Ø  The Buyer(s) agrees to provide annual veterinarian exams, including heartworm checks and monthly preventative tablets or chewables, to do all required vaccinations in accordance with a veterinarian’s schedule, and keep current other voluntary vaccinations according to the veterinarian schedule. Failure to comply with and provide documentation of these requirements voids all guarantees.

Ø  The Buyer(s) understands that the Puppy is never to be left outside unattended, except when proper shelter, food, and water are accessible to the dog.

Ø  If the Puppy becomes lost or stolen, the Buyer(s) agrees to notify the Seller immediately, within 24 hours. The Seller will not be responsible for this loss and will not refund anything, nor will Seller give another puppy for replacement. The Buyer(s) also agrees not to sell, trade or dispose of this puppy without notifying the Seller. If, at any time, the Buyer(s) are unable or unwilling to care for this dog, the Buyer(s) agrees to return the Puppy to the Seller for a refund of the purchase price, minus deposit. The cost of transporting the dog back to the Seller is the Buyer’s expense.

Ø  The Buyer(s) agree to notify the Seller within 10 days of any change of address or phone number; likewise, the Seller will do the same.

Ø  It is also understood that the Seller may examine and make inquiries about the Puppy at any time. If the Seller is not satisfied with the condition of the Puppy or the conditions in which it is kept, the Buyer will be advised to improve the conditions within a timeframe agreed upon between the Buyer(s) and the Seller.

                The Seller will be given FIRST option to repurchase or take repossession of the dog should the Buyer not be able to keep the dog for whatever reason.

This contract contains the entire agreement between the parties and no statement or verbal agreements made by either party that are not contained in this written contract shall be valid or binding, unless they occur after the date of the contract. This contract may not be modified or altered except in writing and signed by both parties, or verbally as agreed by both parties. Violations of this Contract will constitute BREACH of CONTRACT, prosecutable by law, and may result in mandatory confiscation and return of the puppy to the Seller. In the event the Buyer fails to perform any provision of this agreement, the breeder may revoke this agreement of sale and reclaim possession of this dog with the purchaser forfeiting all further rights to the dog.

Sellers and Buyer(s) agree to abide by the terms of this Agreement.

УСЛОВИЯ

Собака покинет питомник будучи здоровой, без инфекционных заболеваний иди физических дефектов.

Покупатель обязуется показать собаку ветеринару в течение 48 часов после получения собаки. В противном случае этот договор теряет силу.

Если ветеринар решит, что собака находится в плохом состоянии, ветеринар должен предоставить письменное доказательство/справку.

Справка и собака должны быть отправлены обратно заводчику/агенту в течение 48 часов. Затем собака будет осмотрена ветеринаром заводчика/агента. Покупателю будет предложен равноценный щенок, как только родится новый помет, в том случае, если диагноз подтвердится ветеринаром заводчика/агента.

ДОПОЛНИТЕЛЬНЫЕ УСЛОВИЯ

Покупатель обязуется правильно содержать собаку (правильное питание, соответствующие возрасту нагрузки и т.п.)

Заводчик не несет ответственность за любой, причиненный собакой урон после ее покупки.

Существует ряд заболеваний (связанных с экологическими факторами и стрессом), за которые заводчик/агент ответственности не несет: понижение иммунитета, блохи, клещи, отиты, аллергия, тепловой удар, пневмония и т.п.

Покупатель обязуется ежегодно приводить собаку на ветосмотр и проводить надлежащую вакцинацию.

Покупатель обязуется держать собаку под присмотром вне дома.

Если собака потерялась, покупатель обязуется оповестить заводчика/агента в течение 24 часов.

Покупатель обязуется не продвать/отдавать собаку, не получив разрешения заводчика/агента.

Покупатель обязуется известить заводчика/агента в случае переезда, смены адреса, телефона и т.д. в течение 10 дней.

Заводчик/агент имеет право справляться о здоровье и благосостоянии собаки в любое время.

Также заводчику/агенту предоставляется право выкупа собаки, если Покупатель не может содержать собаку.

В случае нарушения любого из пунктов соглашения, заводчик/агент имеет право изъять собаку у Покупателя, тем самым получая все права на нее.

Заводчик/агент и Покупатель соглашаются придерживаться всех пунктов этого договора.
